LLC "RAMENSKIY KONDITERSKIY KOMBINAT"* DISAGREED WITH THE CONCLUSIONS IN THE CASE OF UNFAIR COMPETITION

AND DISPUTE IN THE  ARBITRATION COURT DECISION AND ORDER OF THE FEDERAL ANTIMONOPOLY SERVICE OF RUSSIA IN THE MOSCOW REGION IN THE CASE OF UNFAIR COMPETITION

December 11, 2014 The Federal Antimonopoly Service of Russia in the Moscow region has issued a decision in the case of violation of  Ramenskiy Konditerskiy Kombinat paragraph 2 of part 1 of article 14 of the Law on protection of competition. According to the Antimonopoly authority, LLC "Ramenskiy Konditerskiy Kombinat ", the dealer of  LLC "RKK Trade", was carried out by unfair competition by the introduction into civil circulation sponge cakes "Baker House" with the use of cardboard packaging design (shell), similar to the degree of mixing with the design of cartons used by LLC "Farretti Rus».

LLC " Ramenskiy Konditerskiy Kombinat " does not agree with the conclusions of the competition authority , considers them unreasonable and not confirmed by the materials of the case. Design solutions used at the time of packaging "Catalan pies", became the subject of antitrust proceedings are the result of independent developments of  Ramenskiy Konditerskiy Kombinat, the exclusive rights owned by the Company that has not been properly investigated and evaluated by the competition authority when making a decision. The competition authority has not carried out its own research on the question of similarity of packaging products from different manufacturers, and materials used, according to the Company, do not reflect the opinions of consumers in exercising their choice of products.

In this regard LLC " Ramenskiy Konditerskiy Kombinat" submitted an application for review of decisions of the Arbitration court of Moscow and issued on its basis, the requirements of The Federal Antimonopoly Service of Russia in the Moscow region.

The society notes that, in accordance with article 52 of the Law on Protection of Competition, , the execution of the order the Antimonopoly authority will be suspended until the date of the decision of the court of arbitration in force since the adoption of the statement on appeal provisions to the arbitration court. Thus, the output of the Antimonopoly authority on violation of LLC " Ramenskiy Konditerskiy Kombinat", in accordance with article 14 of the Law on Protection of Competition and issued order will be subject to judicial review.        * LLC "RKK Trade" - the official dealer of " Ramenskiy Konditerskiy Kombinat "
